1. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using the WiBAS mobile application ("App," "Service," or "Platform"), you ("User," "you," or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, you must not use the App and should uninstall it immediately.
These Terms constitute a legally binding agreement between you and WiBAS ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the App after modifications constitutes acceptance of the revised Terms. We will notify users of material changes through in-app notifications or email.
2. ELIGIBILITY
2.1 Age Requirement
You must be at least 14 years of age to create an account and use this App. By using WiBAS, you represent and warrant that you are at least 14 years old. WiBAS is not intended for and shall not be used by anyone under the age of 14. We do not knowingly collect information from individuals under 14.
2.2 Gender Requirement
WiBAS is a women-focused marketplace platform. During registration, users are required to confirm their gender identity. The available options are "Female" and "Prefer not to say." This is intended to maintain the community focus of the platform.
2.3 Geographic Availability
WiBAS currently operates within India. Users must have a valid Indian phone number (+91) and address to register and use the platform.
2.4 Account Restrictions
You may only create and maintain one active account. Creating multiple accounts is prohibited and may result in immediate termination of all accounts.
3. ACCOUNT REGISTRATION AND SECURITY
3.1 Registration
To access the App's features, you must create an account by providing:
- A valid 10-digit Indian mobile phone number
- A password (minimum 8 characters)
- Full name
- Gender selection
- Role selection (Buyer or Seller)
- Complete address and 6-digit pincode
- Optional: Email address and profile photo
3.2 Account Verification
Your account will be authenticated using your phone number and password. You must complete all registration steps and pay the applicable subscription fee before accessing the platform.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to:
- Create a strong, unique password
- Not share your account credentials with any other person
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
3.4 Accurate Information
You agree that all information provided during registration and at any time thereafter is truthful, accurate, current, and complete. Providing false, misleading, or fraudulent information is grounds for immediate account termination.
3.5 Device Security
Your authentication tokens are stored securely on your device. If your device is lost, stolen, or compromised, you should change your password immediately or contact support to suspend your account.
4. SUBSCRIPTION AND PAYMENTS
4.1 Subscription Model
WiBAS operates on a paid subscription model. Access to the platform's features requires an active subscription. Subscription pricing varies by user role (Buyer or Seller) and is displayed on the role selection screen within the app during the registration process.
4.2 Service Fee
All subscription payments to WiBAS are considered non-refundable service fees for platform access and services. By completing the payment, you acknowledge that you are paying a service fee for access to the WiBAS platform, its features, and related services for the subscription period.
The service fee covers:
- Platform access and usage rights for 365 days
- Secure hosting and maintenance of your profile and listings
- Access to buyer and seller network
- Technical support and platform updates
- Data security and privacy protection measures
- Payment processing and transaction security
- Content moderation and safety features
4.3 Payment Processing
All service fee payments are processed securely through Razorpay, a third-party payment gateway. By making a payment, you also agree to Razorpay's terms of service and privacy policy. We support payment methods including UPI, credit/debit cards, net banking, and digital wallets. The payment is a service fee for platform access and is non-refundable once processed.
4.4 Subscription Duration
Each subscription grants access for 365 days (one year) from the date of payment confirmation. The service fee is charged upfront for the entire annual period.
4.5 Grace Period
Upon subscription expiry, a 3-day grace period is provided during which you may renew your subscription without losing access. After the grace period, your access to platform features will be suspended until renewal.
4.6 No Refund Policy - Service Fee Terms
All subscription payments are final and non-refundable as they constitute service fees for platform access.
Important: The payment you make to WiBAS is a service fee, not a purchase of goods or a deposit. This service fee grants you access to the platform and its services for a specified period. Once the service fee is paid and platform access is granted, it is considered fully rendered and is therefore non-refundable.
Refunds are not offered once a payment has been successfully processed and confirmed because:
- The service fee is clearly displayed on the role selection screen before payment
- Platform access and services are immediately activated upon payment confirmation
- The service fee covers ongoing operational costs and platform maintenance
- You have the opportunity to review pricing before completing payment
Limited Exceptions: Refunds may be considered only in the following exceptional circumstances, at our sole discretion:
- Duplicate charges resulting from technical errors
- Payment processing errors that result in incorrect charges
- Cases where platform access was not activated due to technical failure
To request a refund review for exceptional circumstances, contact support@wibas.in within 48 hours of payment with transaction details. Refund requests are reviewed case-by-case and approval is not guaranteed.
4.7 Service Fee Pricing Changes
We reserve the right to change service fee pricing at any time. Any price changes will not affect active subscriptions and will only apply to new or renewed subscriptions after the effective date of the change. Updated pricing will always be displayed on the role selection screen before payment.
4.8 Failed Payments
If a payment fails, you may retry the payment. Failed payment attempts are logged for security purposes. In the event of a payment interruption, you may resume the same payment order upon returning to the app. No service fee will be charged until payment is successfully completed and confirmed.
4.9 Service Fee Acknowledgment
By completing the payment process, you explicitly acknowledge and agree that:
- You are paying a service fee for platform access, not purchasing a physical product
- The service fee is non-refundable once platform access is granted
- You have reviewed the service fee amount before completing payment
- You understand the services covered by the fee as outlined in Section 4.2
- You accept the terms of the No Refund Policy as outlined in Section 4.6
5. USER ROLES AND RESPONSIBILITIES
5.1 Buyer Role
Buyers may:
- Browse and search product listings
- View product details and seller information
- Contact sellers via phone call or WhatsApp
- Report inappropriate or fraudulent listings
- Submit feedback and suggestions
5.2 Seller Role
Sellers have all buyer capabilities plus the ability to:
- Post product listings (up to 10 products maximum)
- Upload product images (up to 4 images per product)
- Edit or delete their own product listings
- Set a preferred contact method (phone, WhatsApp, or in-app message)
- View contact request metrics
5.3 Seller Upload Limits
To maintain platform quality and prevent spam:
- Maximum 10 active product listings at any time
6. PROHIBITED CONTENT AND CONDUCT
6.1 Strictly Prohibited Content
Users are strictly prohibited from posting, uploading, sharing, or transmitting any content that:
Sexual and Exploitative Content
- Contains nudity, pornography, or sexually explicit material of any kind
- Contains, promotes, or facilitates child sexual abuse material (CSAM) or child exploitation in any form
- Depicts, promotes, or glorifies sexual abuse, sexual violence, or non-consensual sexual acts
- Contains sexually suggestive content involving minors in any capacity
- Promotes or facilitates sex trafficking or sexual exploitation
Violence and Harmful Content
- Promotes, glorifies, or incites violence against any individual or group
- Contains graphic depictions of violence, gore, or bodily harm
- Promotes self-harm, suicide, or eating disorders
- Contains threats of physical violence or intimidation
- Promotes or provides instructions for acts of terrorism
Hate Speech and Discrimination
- Contains hate speech, slurs, or derogatory language targeting any individual or group based on race, ethnicity, religion, caste, gender identity, sexual orientation, disability, or national origin
- Promotes discrimination, hatred, or hostility towards any community
- Contains content that demeans, dehumanizes, or promotes violence against marginalized groups
Illegal Activities
- Promotes, facilitates, or provides instructions for any illegal activity under Indian law
- Involves the sale or promotion of illegal drugs, controlled substances, or drug paraphernalia
- Involves the sale or promotion of illegal weapons, firearms, ammunition, or explosives
- Facilitates money laundering, fraud, or financial crimes
- Involves counterfeit goods, stolen property, or pirated material
- Violates any applicable local, state, national, or international law or regulation
Fraud and Deception
- Contains false, misleading, or deceptive product descriptions or pricing
- Involves fake or non-existent products listed with intent to defraud
- Involves phishing, scam schemes, or social engineering attacks
- Contains impersonation of other individuals, organizations, or brands
- Involves fake reviews, testimonials, or endorsements
Intellectual Property Violations
- Infringes upon the intellectual property rights of others, including copyrights, trademarks, patents, or trade secrets
- Contains unauthorized use of branded materials, logos, or proprietary content
- Involves the sale of counterfeit products bearing fake trademarks
Harassment and Abuse
- Contains harassment, bullying, stalking, or intimidation of any user
- Contains personal attacks, doxxing, or sharing of someone's private information without consent
- Involves unwanted or repeated contact after a user has indicated they wish to cease communication
Spam and Platform Manipulation
- Contains repetitive, irrelevant, or unsolicited content designed to spam the platform
- Involves creating fake accounts, duplicate listings, or artificially inflating views or contacts
- Involves use of bots, automated tools, or scripts to manipulate the platform
- Involves any attempt to interfere with, disrupt, or gain unauthorized access to the platform's systems
6.2 Prohibited Products
The following products may not be listed on WiBAS under any circumstances:
- Alcohol, tobacco, and nicotine products
- Prescription drugs and controlled pharmaceutical substances
- Illegal or recreational drugs and related paraphernalia
- Weapons, firearms, ammunition, or explosives
- Live animals or regulated animal products
- Human organs, tissues, or body parts
- Hazardous materials, toxic chemicals, or flammable substances
- Counterfeit, pirated, or stolen goods
- Products that violate any applicable law in India
- Adult/sexual products or content
- Gambling or lottery-related items
- Products that facilitate identity theft or fraud
6.3 Prohibited Conduct
Users are prohibited from:
- Attempting to access another user's account without authorization
- Circumventing, disabling, or interfering with security features of the App
- Using the App for any purpose other than legitimate marketplace activities
- Collecting or harvesting user data from the platform without authorization
- Reverse engineering, decompiling, or disassembling any part of the App
- Using the platform to send unsolicited communications or advertisements
- Engaging in any activity that places an unreasonable load on the platform infrastructure
- Reselling or commercially exploiting platform access or features
- Engaging in price manipulation or artificial inflation of product prices
7. CONTENT REPORTING AND MODERATION
7.1 Reporting Mechanism
Users may report any content that violates these Terms using the in-app report feature. Reports can be filed under the following categories:
- Spam or Misleading content
- Inappropriate Content
- Fake Product
- Potential Scam
- Duplicate Listing
- Other
7.2 Moderation Process
All reports are reviewed by our moderation team. We reserve the right to:
- Remove any content that violates these Terms, at our sole discretion
- Issue warnings to users who post violating content
- Suspend or terminate accounts of repeat or serious offenders
- Contact users for clarification regarding reported content
- Refer matters to law enforcement where legally required
7.3 Reporting Obligation
If you encounter content involving child exploitation, child sexual abuse material, or any content that endangers the safety of a minor, you are strongly urged to report it immediately through the App and also to law enforcement authorities. In India, such content can also be reported to the National Center for Missing and Exploited Children (NCMEC) or the Indian Cyber Crime Coordination Centre.
7.4 Cooperation with Law Enforcement
We will fully cooperate with law enforcement authorities in investigations related to illegal activities conducted on or through the platform, including but not limited to child exploitation, fraud, harassment, and other criminal offenses. We may disclose user data to law enforcement without prior notice to the user when required by law or when we believe in good faith that disclosure is necessary to protect the safety of any person.
8. ACCOUNT TERMINATION AND SUSPENSION
8.1 Termination by User
You may terminate your account at any time by contacting our support team. Upon account termination:
- Your profile and product listings will be removed from the platform
- Your personal data will be processed in accordance with our Privacy Policy
- No refund of subscription fees will be issued for unused portions of the subscription period
8.2 Termination by WiBAS
We reserve the right to suspend or permanently terminate any user account, with or without prior notice, for any of the following reasons:
Immediate Termination (No Warning)
- Posting child sexual abuse material or any content exploiting minors
- Posting sexually explicit, pornographic, or obscene content
- Engaging in fraud, scam, or deceptive activities
- Posting content that promotes terrorism, violence, or hate crimes
- Any criminal activity conducted through the platform
- Creating multiple fraudulent accounts
- Any behavior that poses immediate danger to other users or the platform
Termination After Warning
- Repeated posting of prohibited content after receiving a warning
- Persistent harassment or bullying of other users
- Repeated posting of spam or misleading product listings
- Failure to comply with seller upload limits after notification
- Providing false or misleading profile information
- Repeated violation of any section of these Terms
Suspension
- Suspected fraudulent activity pending investigation
- Multiple reports received from other users pending review
- Account security concerns (suspected unauthorized access)
- Payment disputes or chargebacks
8.3 Effect of Termination
Upon account termination:
- All access to the App and its features is immediately revoked
- Active product listings are removed from public view
- Stored authentication tokens are invalidated
- No refund is issued for remaining subscription period
- We may retain certain data as required by law or for legitimate business purposes
- You may not create a new account without our express consent
8.4 Appeal Process
If you believe your account was terminated in error, you may contact our support team at support@wibas.com within 30 days of termination to request a review. We will review the appeal and notify you of the outcome within a reasonable time. Our decision on the appeal is final.
9. INTELLECTUAL PROPERTY
9.1 WiBAS Intellectual Property
WiBAS, including its name, logo, design, interface, code, and all related content, is the intellectual property of WiBAS and is protected under applicable Indian intellectual property laws. WiBAS™ is a registered trademark. All rights reserved.
9.2 User-Generated Content
By posting content (including product listings, images, descriptions, and profile information) on WiBAS, you:
- Retain ownership of your original content
- Grant WiBAS a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the platform for the purpose of operating and improving the Service
- Represent and warrant that you own or have the necessary rights to post the content
- Agree that this license terminates when your content is deleted from the platform, except where content has been shared with third parties or is required for legal compliance
9.3 Copyright Infringement
If you believe any content on WiBAS infringes your copyright, please contact us at support@wibas.com with the following information:
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material
- Your contact information
- A statement of good faith belief that the use is unauthorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
10. ADVERTISEMENTS
10.1 Third-Party Advertisements
WiBAS displays advertisements on the platform. These advertisements may be managed by third-party services or by our internal team.
10.2 Advertisement Content
All advertisements on the platform are subject to approval by our moderation team. Advertisements must comply with all applicable laws and these Terms. We reserve the right to reject or remove any advertisement at our sole discretion.
10.3 Disclaimer
WiBAS does not endorse, guarantee, or assume responsibility for any product, service, or content advertised on the platform by third parties. Interaction with advertisers is at your own risk.
11. DISCLAIMERS AND LIMITATION OF LIABILITY
11.1 Platform Role
WiBAS is a marketplace platform that connects buyers and sellers. We do not:
- Manufacture, sell, or endorse any products listed on the platform
- Guarantee the quality, safety, legality, or authenticity of any products
- Guarantee the accuracy of product descriptions, prices, or seller claims
- Act as an intermediary in transactions between buyers and sellers
- Provide escrow services or buyer/seller protection programs
11.2 As-Is Service
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We disclaim all warranties including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service.
11.3 Limitation of Liability
To the maximum extent permitted by applicable law, WiBAS and its directors, officers, employees, agents, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of data, profits, revenue, or business opportunities
- Service interruptions, bugs, errors, or security breaches
- Actions or content posted by other users
- Third-party products, services, or websites
- Any damages arising from transactions between users
11.4 Maximum Liability
Our total cumulative liability for any claim arising from or relating to these Terms or the Service shall not exceed the amount you paid to us in subscription fees during the 12-month period preceding the claim.
11.5 User Transactions
All transactions between buyers and sellers are conducted directly between those parties. WiBAS is not a party to any transaction and bears no responsibility for disputes, delivery issues, product quality, or payment matters between users outside of the subscription payment.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless WiBAS and its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the App
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Content you post or transmit through the App
- Your interaction with other users
- Any dispute between you and another user
- Any third-party claim arising from your use of the Service
13. PRIVACY
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms. By using WiBAS, you consent to the practices described in the Privacy Policy.
14. THIRD-PARTY SERVICES
14.1 Integrated Services
WiBAS integrates with the following third-party services:
- Razorpay: Payment processing
- WhatsApp: Communication between buyers and sellers (via external app)
14.2 Third-Party Terms
Your use of third-party services is governed by their respective terms and privacy policies. WiBAS is not responsible for the practices or content of any third-party service.
15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:
- The Information Technology Act, 2000 and its amendments
- The Consumer Protection Act, 2019
- The Indian Contract Act, 1872
- The Payment and Settlement Systems Act, 2007
15.2 Jurisdiction
Any legal proceedings arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts in Nashik, Maharashtra, India.
15.3 Dispute Resolution
In the event of any dispute arising from these Terms, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue arbitration under the Arbitration and Conciliation Act, 1996, or file a claim in the appropriate court.
16. GENERAL PROVISIONS
16.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and WiBAS regarding the use of the App.
16.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
16.5 Force Majeure
WiBAS shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, wars, terrorism, government actions, pandemics, internet outages, or other force majeure events.
16.6 Language
These Terms are provided in the English language. In the event of any conflict between the English version and a translated version, the English version shall prevail.
16.7 Survival
The provisions of Sections 6 (Prohibited Content), 9 (Intellectual Property), 11 (Disclaimers and Limitation of Liability), 12 (Indemnification), and 15 (Governing Law) shall survive any termination of these Terms.

By creating an account and using WiBAS, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
